The following terms and conditions (the “Terms”), together with any information contained in any event invitations, booking forms, booking confirmations, and email communications, apply to all events (the “Event”) run or organised by or on behalf of Edrington Middle East &amp; Africa Limited (DMCC Branch) (“we” or “the Company”). Edrington Middle East &amp; Africa Limited (DMCC Branch) operates as a branch of Edrington Middle East &amp; Africa Limited, under license number JLT-6947, with its office address at Jumeirah Lakes Towers, JBC1, Unit 4104, Dubai, United Arab Emirates.&nbsp;On registering, accepting, holding and/or using a booking to attend an Event, you accept and agree to be bound by these Terms.&nbsp;&nbsp;

We will endeavour to ensure that the information displayed on our website and booking platform is current and accurate. However, we cannot be held liable for any errors. Use of the website and booking platform is subject to separate Terms of Use available at <a href="https://www.anyroad.com/end-user-terms">AnyRoad</a>; however, in the case of conflict, these Terms shall apply to online bookings of all Events.&nbsp;Admission to the Event is subject to you having been issued with a booking confirmation.&nbsp; The Confirmation may be issued either in the form of an email sent to the email address provided by you and/or through the relevant booking service utilised by the Company from time to time.&nbsp;The Company reserves the sole and absolute discretion to accept or reject any booking forms received. Confirmations are issued subject to availability.&nbsp;&nbsp;We accept no responsibility for the incorrect inputting of an email address on our booking form. If your automatically generated booking confirmation does not arrive via email, please contact us without delay via email at <a href="mailto:contact@themacallan.com">contact@themacallan.com</a>  we will check the email address and resend your booking confirmation(s).&nbsp;Upon receipt of the booking confirmation email, it is your responsibility to check the accuracy of dates booked.&nbsp;

ONLINE BOOKINGS AND WEBSITE

Admission to the Event is free of charge.&nbsp;To attend the Event, you must be over the prevailing legal drinking age in the United Arab Emirates (21 years of age as at the date of these Terms) prior to the date of the Event. On entry, you must display a valid photo identification document such as a passport, driver’s license, Emirates ID card and we reserve the right to verify your age prior to or at the Event.&nbsp;You consent, as a mandatory condition for access to the Event, to a security inspection/screening before and/or during the Event. The security checks may include a body search, bag inspection or inspection of other objects owned and carried by yourself.&nbsp;&nbsp;We may deny entry or evict guests whom the Company has reason to believe are not of the legal drinking age and/or may pose a safety or security risk to other persons at the Event.&nbsp;The date, time and location of the Event shall be clearly stated on the Confirmation, and the Company requests that you arrive in good time for the Event.  All guests should arrive at the Event location at least 10 minutes before the Event is due to start.&nbsp;

PRICING AND ADMISSION POLICY  

We reserve the right to cancel, modify the dates and/or the time of the Event due to events or circumstances beyond our reasonable control, including but not limited to actions of government or state such as period of declared national mourning or public holiday (“Force Majeure Event”), such will be notified to you as soon as practicable.&nbsp; &nbsp;If you need to cancel, please do so via the relevant booking platform, or by emailing us at <a href="mailto:contact@themacallan.com">contact@themacallan.com</a> &nbsp;during business opening hours, at least 48 hours before the Event is scheduled.&nbsp;If you wish to amend the date or time of any booking following the purchase of your Event, you should amend the booking via the relevant booking platform or contact us by email <a href="mailto:contact@themacallan.com">contact@themacallan.com</a> up to 48 hours before the start of the Event. The Company will endeavour to accommodate the alternative date and time requested by you but cannot guarantee availability and shall not in any case be liable for any loss or expenses suffered by you.&nbsp;We shall not be obliged to replace any booking (including but not limited to: (i) if you decide not to attend the Event; (ii) if there is an event of Force Majeure; and/or (iii) if you are denied entry or evicted from the Event for reasons set out in these Terms.&nbsp;

CANCELLATIONS AND AMENDMENTS

Except as required by law, we shall have no liability if you suffer losses as a result of a breach by us of these Terms.&nbsp;We are not responsible for any loss of profit, loss of business, loss of goodwill, or any indirect, special or consequential loss, damage, costs, expenses or other claims which arise in connection with the Event.&nbsp;Notwithstanding the foregoing, nothing in these Terms limits or exclude in any way our liability:&nbsp;For death or personal injury caused by our negligence;&nbsp;Fraud;&nbsp;Or any other liability which cannot be excluded or limited under the applicable law. &nbsp;We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by a Force Majeure Event. Our performance under these terms and conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms and conditions may be performed despite the Force Majeure Event.&nbsp;We do not accept any responsibility for your personal belongings at the Event and you are responsible for making sure you keep your belongings with you or in a safe place at the Event location.&nbsp;

OUR LIABILITY TO YOU

Any personal data which you provide us as part of the booking and attending the Event will be treated securely and confidentially. You hereby consent to the collection, use and disclosure of such personal data provided in the booking form and otherwise in connection with the Event for such purposes as may be necessary or ancillary to the conduct of and your attendance at the Event. Your personal data shall be handled by the Company in accordance with our Privacy Policy, which is available <a href="https://www.themacallan.com/en/privacy-policy">here</a>.&nbsp;

YOUR PRIVACY

Whilst at the Event, guests must observe the following:&nbsp;The guests will be responsible for orderly conduct and shall ensure that nothing shall be done which may constitute a breach of the law or in any way cause a nuisance.&nbsp;The dress code is smart casual, that slippers and/or shorts must not be worn.&nbsp;Smoking or vaping can only be done in outside designated areas.&nbsp;No pets or animals are permitted (with the exception of assistance dogs, subject to the venue prior approval if applicable. Please ensure that you notify our team if you have an assistance dog to make necessary arrangements, to the extent possible)&nbsp;We reserve the right to evict anyone from the Event if their behaviour is considered likely to cause offence, put staff or other guests at risk or create a nuisance to other guests or staff.&nbsp;

GUEST CONDUCT

In the interests of safety, you may be asked to submit to a search of your person or belongings and anyone refusing to submit or found to be in possession of materials believed to be dangerous or unsuitable will be denied entry or evicted from the Event.&nbsp;The Company would ask all guests to remain vigilant and report anything they find suspicious to a member of staff.&nbsp;

SECURITY

Alcoholic beverages for on-site consumption by guests may be provided at the Event.&nbsp;&nbsp;Any alcoholic beverages supplied shall be of satisfactory quality and reasonably fit for consumption. Any other warranties and liabilities of the Company, whether implied by statute or otherwise are hereby excluded to the maximum extent permitted by law.&nbsp;Guests are strongly encouraged to consume alcoholic beverages in a responsible and safe manner and the Company shall not be liable for any losses or damages suffered by you as a result of over-consumption of alcoholic beverages or any resulting nuisance and/or undesirable behaviour.&nbsp;We may refuse alcohol to any attendee who, in the Company’s absolute discretion, is unreasonably intoxicated and/or is behaving in an unacceptable manner.&nbsp;

PROVISION OF ALCOHOLIC BEVERAGES

Guests acknowledge and consent that CCTV cameras will be in operation across the venue for reasons of security and public interest.&nbsp;Unless otherwise notified in writing to the Company prior the Event, Guests consent to be photographed, filmed or taped by the Company, its affiliates and any media appointed by the Company during the Event.&nbsp;Guests consents that the Company, its affiliates and any media appointed by the Company shall have the right to broadcast, publish, license and use in any manner whatsoever any live or recorded audio, video, photographs, recordings or any publication or reproduction of the Event which contains the guest’s image, likeness, actions and statements made of, or at, the Event in any medium or context for any purpose globally without any remuneration or other form of consideration in perpetuity. The Company and any third parties and anyone acquiring from the Company the right to use such material are not liable to the guests in any way for its use.&nbsp;Images, video and sound recordings of the Event taken by the guest with a media capture device such as a mobile phone, tablet, photo camera, video camera, audio equipment or device hereafter existing, cannot be used for any purpose other than for private and domestic purposes. Guests may may not sell, license, broadcast, publish, or otherwise commercially exploit such material including on social networking website and applications as well as the internet more generally or make it available to third parties for commercial purposes.&nbsp;Please be advised that taking photos or shooting videos of other persons in the United Arab Emirates without their consent may be considered an invasion of their privacy and may lead to prosecution. Any liability incurred for doing so is the guest’s own.&nbsp;

ACCESSIBILITY

If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question will not be affected.&nbsp;These Terms and any document expressly referred to in them constitute the whole agreement between you and us and supersede any previous arrangement, understanding or agreement between you and us relating to the subject matter of these Terms.&nbsp;Any contract between you and us pursuant to these Terms will be binding on you and us and on our respective successors and assigns.&nbsp;You may not transfer, assign, charge, sub-contract or otherwise dispose of any such contract, or any of your rights or obligations arising under such a contract, without our prior written consent.&nbsp;These terms and conditions are governed by and construed in accordance with the Laws of Scotland, provided that the Parties shall comply with all mandatory provisions applicable in the United Arab Emirates laws as applied in the emirate of Dubai and to the extent applicable.&nbsp;&nbsp;The parties agree to submit to the exclusive jurisdiction of the courts of Scotland.&nbsp;The Company expressly reserves the right to change and/or amend these Entry Conditions from time to time.&nbsp;

GENERAL

In the unlikely event that you may wish to make a formal complaint in respect of the Event please inform The Macallan Event host that you intend to make a formal complaint. If the matter cannot be resolved immediately, or during the Event, despite the host’s best endeavours to do so, your complaint should be made in writing to <a href="https://www.themacallan.com/en/contact@themacallan.com">contact@themacallan.com</a>. We will review your complaint as soon as is reasonably possible, and you will receive a reply within 21 days.&nbsp;
