The following terms and conditions (the “Terms”), together with any information contained in any event invitation/s, booking forms, booking confirmation, and email communications, apply to all Events run or organised by or on behalf of The Macallan Distillers Limited (“we” or “the Company”). The Macallan Distillers Limited is incorporated in Scotland (Registered No. SC024068), with its registered office at The Macallan Distillery, Craigellachie, Banffshire, AB38 9RX.On booking to attend an Event, you agree on your own behalf and on behalf of all guests which form your party to be bound by these Terms.

We will endeavour to ensure that the information displayed on our website and booking platform is current and accurate. However, we cannot be held liable for any errors. Use of the website and booking platform is subject to separate Terms of Use and AnyRoad’s Terms; however, in the case of conflict, these Terms shall apply to online bookings of Events.Once full payment is made, you will be allocated a place/places for your chosen Event and a booking confirmation will be emailed to you.We accept no responsibility for the incorrect inputting of an email address on our booking form. If your automatically generated booking confirmation does not arrive via email, please contact us via email at contact@themacallan.com we will check the email address and resend your booking confirmation(s).Upon receipt of the booking confirmation email, it is your responsibility to check the accuracy of dates booked.Tickets are non-transferable, and guest names will be checked upon entry.

ONLINE BOOKINGS AND WEBSITE

The price of the Event is as advertised on the booking platform. There are no concessions, and all prices are shown inclusive of VAT. We reserve the right to amend the price of the Event at any time.To attend the Event, you must be over the legal drinking age in the market where the Event is taking place and we reserve the right to verify your age prior to or at the Event.

PRICING AND ADMISSION POLICY

Guests may be subject to an age check on arrival at the Event, so guests should bring photo identification (ID) to the Event. If we believe or suspect a guest who wishes to consume alcohol is under the legal drinking age, that guest will be asked to produce photo ID. In the event that you are unable to produce valid photo ID, we reserve the right to refuse you entry, or ask you to leave the Event and we regret that no refunds can be given.A valid passport, in date driving licence or in date or EU national identity card are acceptable.The date, time and location of the Event will be clearly stated on your email confirmation, and we request that you arrive in good time for the Event. All guests should arrive at the Event location at least 10 minutes before the Event is due to start.We reserve the right to refuse admission to the Event at our absolute discretion.

CONDITIONS OF ENTRY

If we cancel an Event, you will be entitled to a full refund.If you need to cancel or reschedule a booking please email us at contact@themacallan.com or by phone 01340 318000, during business opening hours, at least 5 days before the Event is scheduled.If you do not arrive for an Event, no refund will be given for the Event unless you have given us at least 5 days notice of your cancellation.You are entitled to a full refund if you give us notification, via the booking platform, email or phone call, of your wish to cancel your booking at least 5 days before the Event begins.If you wish to amend the date or time of any booking following the purchase of your Event, you should amend the booking via the booking platform or contact us by email at contact@themacallan.com or by phone 01340 318000, up to 5 days before the start of the Event.

CANCELLATIONS AND AMENDMENTS

There will be limitations on the number of tickets you can buy. The number will be stated on the booking page. This policy applies to prevent malpractice in the purchasing of tickets and we reserve the right to cancel any tickets which we reasonably believe have been purchased in excess of this cap, or were otherwise purchased in breach of these Terms.If you are an individual consumer booking an Event then please note that we only provide the tickets for your personal use and you agree not to use the tickets or re-sell the tickets for any commercial or business purposes. If you purchase any ticket from anyone other than The Macallan then you acknowledge that such tickets may not be valid, and we reserve the right to refuse admission to an Event where such tickets are presented for entry. Any person identified as buying and then reselling the tickets for commercial purposes or profit acknowledges that such tickets shall become invalid, and we reserve the right to refuse admission to an Event where such tickets are presented for entry. We may also seize and/or cancel without refund and ticket purchase using (or suspected to be using) methods generated by a script, macro, ticket botor automated devices. Information regarding the purchase of a ticket in such manner and its holder may be passed on to the relevant authorities.

PROHIBITIONS

If you suffer losses as a result of a breach by us of these Terms, our liability is strictly limited to the purchase price of the booking for the Event. We are not responsible for any loss of profit, loss of business, loss of goodwill, or any indirect, special or consequential loss, damage, costs, expenses or other claims which arise in connection with the Event.Notwithstanding the foregoing, nothing in these Terms limits in any way our liability:For death or personal injury caused by our negligence;Under section 2(3) of the Consumer Protection Act 1987;For fraud or fraudulent misrepresentation; orFor any matter which cannot be excluded by law.We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control (“Force Majeure Event”). Our performance under these terms and conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms and conditions may be performed despite the Force Majeure Event.We do not accept any responsibility for your personal belongings at the Event and you are responsible for making sure you keep your belongings with you or in a safe place at the Event location.

OUR LIABILITY TO YOU

Any personal data which you provide us as part of the booking and attending the Event will be treated securely and confidentially. YOUR PRIVACY

Please note that all The Macallan Estate Experiences need to be pre-booked. We do not accept walk-in bookings.

WALK IN BOOKINGS

Whilst at the Event, guests must observe the following:The guests will be responsible for orderly conduct and shall ensure that nothing shall be done which may constitute a breach of the law or in any way cause a nuisance.Smoking or vaping can only be done in outside designated areas.No pets or animals are permitted in The Macallan Distillery (with the exception of assistance dogs, please ensure that you notify our team if you have an assistance dog as there are parts of the experience where an alternative arrangement may need to be made)We support responsible drinking and due to the intimate nature of these events, and we reserve the right to refuse entry to guests who are intoxicated.We reserve the right to remove anyone from the Event if their behaviour is considered likely to cause offence, put staff or other guests at risk or create a nuisance to other guests, staff or performers.

GUEST CONDUCT

In the interests of safety, guests may be asked to submit to a search of their person or belongings and anyone refusing to submit or found to be in possession of materials believed by us to be dangerous or unsuitable will be denied entry or removed from the Event.We would ask all guests to remain vigilant and report anything they find suspicious to a member of staff.

SECURITY

The Company may provide and supply alcoholic beverages for on-site consumption by guests. Any alcoholic beverages supplied shall be of satisfactory quality and reasonably fit for consumption. Any other warranties and liabilities of the Company, whether implied by statute, common law or otherwise are hereby excluded to the maximum extent permitted by law.The Participants are strongly encouraged to consume alcoholic beverages in a responsible and safe manner and the Company shall not be liable for any losses or damages suffered by you as a result of over-consumption of alcoholic beverages or any resulting nuisance and/or undesirable behaviour.

PROVISION OF ALCOHOLIC BEVERAGES

From time to time we, or other authorised third parties, may take photos or other recordings at the Event and any images or recordings may feature guests. We, or our authorised third parties, will use such photos and recordings in accordance with our privacy policy for promotional purposes.If you do not want to feature in any photographs you must let us know in advance.For our guests, small, pocket-sized cameras – no lenses - and phones are allowed. For the safety of artists and the comfort of audience members, only pictures without flash and short videos below the shoulder are permitted.

PHOTOGRAPHY AND FILM

We hope that all guests enjoy their experience at the Event. If you require any extra assistance or have any special requirements please contact us in advance of your attendance at an Event via email contact@themacallan.com or by phone 01340 318000 to ensure that you receive the best possible experience. Unfortunately, assistance cannot be guaranteed to guests who do not book in advance and notify us of any assistance they may require.

ACCESSIBILITY

We reserve the right to refuse to process a transaction for any reason.If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question will not be affected.These Terms and any document expressly referred to in them constitute the whole agreement between you and us and supersede any previous arrangement, understanding or agreement between you and us relating to the subject matter of these Terms.Any contract between you and us pursuant to these Terms will be binding on you and us and on our respective successors and assigns.Tickets are non-transferable. You may not transfer, assign, charge, sub-contract or otherwise dispose of any such contract, or any of your rights or obligations arising under such a contract, without our prior written consent.These terms and conditions are governed by and construed in accordance with the Laws of Scotland, and the parties agree to submit to the exclusive jurisdiction of the courts of Scotland.

GENERAL

In the unlikely event that you may wish to make a formal complaint in respect of the Event please inform The Macallan Event host that you intend to make a formal complaint. If the matter cannot be resolved immediately, or during the Event, despite the host’s best endeavours to do so, your complaint should be made in writing to contact@themacallan.com. We will review your complaint as soon as is reasonably possible, and you will receive a reply within 21 days.
